Terms & conditions for using the Imagebank
If I upload images, what are my rights?
All files are uploaded into a folder with your user name; your user name will be preserved as a tag for all images you upload. By uploading images into the imagebank you are agreeing that they be made freely available under the imagebank terms and conditions set out below. You're also agreeing that Imagebank administrators have a perpetual royalty-free license to store, index, manipulate, incorporate into other works to be made available under the imagebank license, and make publicly available the images. As you'd expect, we reserve the right to refuse to list images which we consider are not appropriate for use in Christian worship, talks or events, including any material considered pornographic or defamatory.
By uploading files to the imagebank you also confirm that you are either the owner of the copyright in the images uploaded, or that the copyright owner has agreed to make the images available under the terms of the imagebank license and the conditions noted above. Imagebank will not be held responsible for copyright infringement by users uploading. Copyright in all works always remains with the uploading user.
what can I do with imagebank digital media?
Subject to the terms of this Agreement between you and the Imagebank, you have the non-exclusive, non-transferable, non-sublicensable right to copy, reproduce, transmit and display all Digital Media an unlimited number of times in any and all media for the following purposes:
- Use in worship services, prayer meetings, fellowship groups and similar Christian sessions and events;
- Use in meetings of small groups for the purposes of Christian fellowship, learning or worship; and
- Any other uses approved in writing by Imagebank.
What can't I do?
You may not sublicense, sell, assign, convey or transfer any of your rights under this Agreement. You may not post the Digital Media online in a downloadable format.
The Digital Media may not be used in a pornographic, defamatory, libelous or otherwise illegal manner, whether directly or in context or juxtaposition with other materials. Imagebank grants no rights and makes no warranties with regard to the use of names, trademarks, trade dress, registered, unregistered or copyrighted designs or works of art or architecture depicted in any Licensed Material, and you must satisfy yourself that all the necessary rights or consents regarding any of the above, as may be required for reproduction, have been obtained.
Indemnity
You agree to indemnify and hold imagebank harmless against all claims arising out of any breach of this Agreement.
Warranties
IMAGEBANK MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE DIGITAL MEDIA, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IMAGEBANK SHALL NOT BE LIABLE TO YOU OR ANY OTHER PERSON OR ENTITY FOR ANY GENERAL, PUNITIVE, SPECIAL, DIRECT, INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES, OR LOST PROFITS OR ANY OTHER DAMAGES, COSTS OR LOSSES ARISING OUT OF YOUR USE OF THE DIGITAL MEDIA, THIS AGREEMENT OR OTHERWISE, EVEN IF IMAGEBANK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, COSTS OR LOSSES.
Termination and Revocation
The license contained in this Agreement will terminate automatically without notice from Imagebank if you fail to comply with any provision of this Agreement.
Upon termination, you must immediately
- stop using the Digital Media,
- destroy or, upon the request of Imagebank, return the Digital Media to us (in the case of analogue materials), and
- delete or remove the Digital Media from your premises, computer systems and storage (electronic or physical).
Imagebank reserves the right to revoke the license to use the Digital Media for good cause. Upon notice of any revocation of a license for any particular Digital Media, you shall immediately cease using such Digital Media.
